Terms of Service

These Terms of Service (“Terms”) govern access to and use of AskNotes (the website, application, and related services, together the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy.
If you use the Service on behalf of an organisation (for example a school or study group admin), you represent that you have authority to bind that organisation, and “you” includes that organisation.
1. Who may use the Service
You must be able to form a binding contract under applicable law. If you are under the age of digital consent in your country (often 16 in the EU), you may only use the Service with permission and supervision of a parent or legal guardian where required.
You may not use the Service if you are barred under applicable sanctions or export laws, or if we have previously suspended your access.
2. The Service
AskNotes provides tools to organise study notes (for example by subject and lecture) and optional AI-assisted study features such as chat, quizzes, flashcards, summaries, and explanations.
We may change, suspend, or discontinue features at any time. We do not guarantee that any particular feature will remain available indefinitely.
Early / evolving product. AskNotes may be offered in beta or early-access form. Features, storage models, and pricing may change as we develop the Service.
3. Accounts, devices, and local storage
In the current version, much of your content (notes, preferences, credits counters, and related data) may be stored locally in your browser on the device you use. You are responsible for:
- Maintaining control of devices that have access to your data;
- Understanding that clearing browser storage or switching devices may delete content permanently;
- Exporting or backing up anything you cannot afford to lose.
If we later introduce accounts or cloud sync, additional terms may apply. You must keep login credentials confidential and notify us of unauthorised access.
4. Acceptable use
You agree not to:
- Use the Service for anything illegal, harmful, or fraudulent;
- Upload or generate content that infringes intellectual property, privacy, or other rights of others;
- Submit malware, or attempt to probe, scan, or breach the Service;
- Abuse, overload, or reverse engineer the Service except to the extent permitted by mandatory law;
- Bypass credit limits, rate limits, or access controls;
- Use AI features to cheat in a way that violates your school’s academic integrity rules (you remain solely responsible for how you use outputs in coursework and exams);
- Misrepresent AI-generated content as solely your original work where disclosure is required;
- Harass others or share others’ personal data in workspaces without a lawful basis.
We may suspend or terminate access if we reasonably believe you violated these Terms or create risk for the Service or other users.
5. Your content
You retain ownership of the notes and other content you create (“User Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, process, transmit, and display User Content solely as needed to operate and improve the Service, including sending relevant excerpts to AI providers when you invoke AI features.
You represent that you have all rights needed to submit User Content and that doing so does not violate law or third-party rights.
Shared workspaces: if you invite others, you understand they may see content shared in that workspace according to the feature’s design. You are responsible for who you invite.
6. AI features and credits
6.1 Nature of AI outputs
AI features generate probabilistic outputs that may be wrong, incomplete, biased, or inappropriate. Outputs are for study support only and are not academic, legal, medical, or professional advice. Always verify important information against your course materials.
6.2 Credits and packs
Certain AI actions consume credits. Credit balances and costs per action may change. Unless required by law, credits are non-refundable and have no cash value. Unused credits may expire if we state so at purchase or in-product.
6.3 Third-party models
AI requests may be processed by third-party providers. Your use of AI features is also subject to those providers’ acceptable-use rules. We are not responsible for outages or policy changes by those providers.
7. Fees and payments
Paid features (if any) are billed through our payment partner. Prices include or exclude taxes as shown at checkout. You authorise us and the payment provider to charge your selected payment method.
Except where mandatory consumer law requires otherwise, purchases are final once credits or access have been delivered. If you believe a charge is incorrect, contact us promptly.
8. Intellectual property
The Service — including software, design, trademarks, and documentation — is owned by AskNotes or its licensors. These Terms do not transfer ownership to you. You may not copy, modify, or distribute our materials except as allowed by the Service’s normal use or with prior written permission.
9. Feedback
If you send ideas or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use them without restriction or compensation.
10. Third-party services
The Service may link to or integrate third-party services (hosting, payments, AI providers, media links you add). We are not responsible for third-party content, policies, or outages.
11. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT (INCLUDING AI OUTPUTS) WILL BE ACCURATE OR COMPLETE.
Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable consumer law.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKNOTES AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR STUDY OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) EUR 50.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
13. Indemnity
You will defend and indemnify AskNotes and its contributors against claims, damages, and costs (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law, except to the extent caused by our wilful misconduct.
14. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access immediately if you breach these Terms, if required by law, or if continued operation creates risk. Upon termination, sections that by nature should survive (including IP, disclaimers, limitations, and indemnity) will survive.
15. Changes to the Terms
We may update these Terms by posting a revised version and updating the “Last updated” date. Material changes may be highlighted in the Service. If you continue using the Service after changes take effect, you accept the revised Terms where permitted by law. If you do not agree, stop using the Service.
16. Governing law and disputes
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules, unless mandatory consumer protection law in your country of residence requires otherwise.
Courts of the Netherlands have exclusive jurisdiction, except that consumers may bring claims in their country of residence where mandatory law so provides. Either party may seek interim relief in any competent court.
17. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement regarding the Service.
- Severability. If a provision is unenforceable, the remainder stays in effect.
- No waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, sale, or reorganisation.
- Language. These Terms may be translated; if there is a conflict, the English version controls unless mandatory law says otherwise.
